1. Context
2. What is a Heat Wave?
- A heatwave is a period of abnormally high temperatures, a common phenomenon in India during the months of May-June and in some rare cases even extends till July.
- Indian Meteorological Department (IMD) classifies heat waves according to regions and temperature ranges. As per IMD, the number of heatwave days in India has increased from 413 over 1981-1990 to 600 over 2011-2020.
- This sharp rise in the number of heatwave days has resulted due to the increasing impact of climate change.
- The last three years have been La Niña years, which has served as a precursor to 2023 likely being an El Niño year. (The El Niño is a complementary phenomenon in which warmer water spreads westeast across the equatorial Pacific Ocean.)
- As we eagerly await the likely birth of an El Niño this year, we have already had a heat wave occur over northwest India.
- Heat waves tend to be confined to north and northwest India in El Niño years.

- Imagine placing a large lid over a pot of boiling water. The lid traps the heat and steam underneath, causing the temperature inside the pot to rise. A heat dome works in a somewhat similar way in the atmosphere.
- A heat dome is a weather phenomenon that occurs when a strong area of high atmospheric pressure settles over a region and remains there for several days or even weeks.
- Under normal conditions, warm air near the Earth's surface rises, cools at higher altitudes, and is replaced by relatively cooler air. This continuous movement helps regulate temperatures.
- However, when a high-pressure system becomes unusually strong, it acts like a giant atmospheric lid. The air beneath it is forced downward, a process known as subsidence. As the air sinks, it gets compressed and warms further.
- Since the high-pressure system suppresses cloud formation and rainfall, sunlight reaches the ground unhindered, heating the surface throughout the day.
- The heated ground then warms the air above it. But because the "lid" of high pressure prevents the warm air from escaping upward efficiently, the heat becomes trapped and accumulates. Day after day, temperatures continue to rise, creating prolonged periods of extreme heat.
- The term "dome" is used because meteorologists often observe a dome-shaped bulge of high pressure in weather maps and upper-atmosphere charts. This dome effectively traps hot air beneath it over a large area.
- A heat dome can have serious consequences. It can trigger severe heat waves, increase the risk of heat-related illnesses such as heat exhaustion and heat stroke, worsen drought conditions, strain electricity grids due to increased air-conditioning use, and contribute to wildfires by drying out vegetation.
- One well-known example occurred in western North America during the summer of 2021, when a powerful heat dome caused record-breaking temperatures in parts of the United States and Canada. In some locations, temperatures exceeded 49°C, leading to significant health and environmental impacts.
- In simple terms, a heat dome is a persistent high-pressure system that traps and intensifies heat near the Earth's surface, much like a lid trapping heat inside a cooking pot, resulting in unusually high temperatures over a region for an extended period
4. How do Heat waves Occur?
- Heat waves are formed for one of two reasons warmer air is flowing in from elsewhere or it is being produced locally.
- It is a local phenomenon when the air is warmed by higher land surface temperature or because the air sinking down from above is compressed along the way, producing hot air near the surface.
- First of all, in spring, India typically has air flowing in from the westnorthwest. This direction of airflow is bad news for India for several reasons.
- Likewise, air flowing in from the northwest rolls in over the mountains of Afghanistan and Pakistan, so some of the compression also happens on the leeward side of these mountains, entering India with a bristling warmth.
- While air flowing over the oceans is expected to bring cooler air, the Arabian Sea is warming faster than most other ocean regions.
- Next, the strong upper atmospheric westerly winds, from the Atlantic Ocean to India during spring, control the near-surface winds.
- Any time winds flow from the west to the east, we need to remember that the winds are blowing faster than the planet which also rotates from west to east.
- The energy to run past the earth near the surface, against surface friction, can only come from above. This descending air compresses and warms up to generate some heat waves.
5. Impacts of heat waves in India
- The frequent occurrence of heat waves also adversely affects different sectors of the economy.
- For instance, the livelihood of poor and marginal farmers is negatively impacted due to the loss of working days.
- Heatwaves also have an adverse impact on daily wage workers' productivity, impacting the economy.
- Crop yields suffer when temperatures exceed the ideal range.
- Farmers in Haryana, Punjab, and Uttar Pradesh have reported losses in their wheat crop in the past rabi season. Across India, wheat production could be down 6-7% due to heat waves.
- Mortality due to heat waves occurs because of rising temperatures, lack of public awareness programs, and inadequate long-term mitigation measures.
- According to a 2019 report by the Tata Center for Development and the University of Chicago, by 2100 annually, more than 1.5 million people will be likely to die due to extreme heat caused by climate change.
- The increased heat wave will lead to an increase in diseases like diabetes, circulatory and respiratory conditions, as well as mental health challenges.

The concurrence of heat and drought events is causing crop production losses and tree mortality. The risks to health and food production will be made more severe by the sudden food production losses exacerbated by heat-induced labor productivity losses.These interacting impacts will increase food prices, reduce household incomes, and lead to malnutrition and climate-related deaths, especially in tropical regions.
6. How does air mass contribute to heat waves?
- The other factors that affect the formation of heat waves are the age of the air mass and how far it has traveled.
- The north northwestern heatwaves are typically formed with air masses that come from 800-1600 km away and are around two days old.
- Heat waves over peninsular India on the other hand, arrive from the oceans, which are closer (around 200-400km) and are barely a day old. As a result, they are on average less intense.
7. Way ahead for Heat waves
- Identifying heat hot spots through appropriate tracking of meteorological data and promoting timely development and implementation of local Heat Action Plans with strategic inter-agency coordination, and a response that targets the most vulnerable groups.
- Review existing occupational health standards, labor laws, and sectoral regulations for worker safety in relation to climatic conditions.
- Policy intervention and coordination across three sectors health, water, and power are necessary.
- Promotion of traditional adaptation practices, such as staying indoors and wearing comfortable clothes.
- Popularisation of simple design features such as shaded windows, underground water storage tanks, and insulating house materials.
- Advance implementation of local Heat Action Plans, plus effective inter-agency coordination is a vital response that the government can deploy in order to protect vulnerable groups.

ARAVALLI RANGE
- Beyond being almost two billion years old and the oldest mountain system in India, these hills function as a vital ecological shield against the advance of desert conditions into the Indo-Gangetic plains.
- They act as a natural barrier slowing the eastward expansion of the Thar Desert into Haryana, Rajasthan, and western Uttar Pradesh. The range plays a crucial role in climate regulation, biodiversity conservation, and groundwater replenishment.
- Extending roughly 650 km from Delhi to Gujarat, it supports key water-recharge networks and gives rise to major rivers such as the Chambal, Sabarmati, and Luni.
- The region is abundant in building stones like sandstone, limestone, marble, and granite, as well as minerals including lead, zinc, copper, gold, and tungsten.
- Although these resources have been extracted for centuries, the last forty years have seen rampant stone and sand quarrying, leading to declining air quality and a sharp reduction in groundwater recharge.
- Part of this mining activity has occurred unlawfully. The Court also observed that India has international obligations under the United Nations Convention to Combat Desertification to safeguard fragile ecosystems like the Aravalli range

- The Aravalli Range is one of the oldest fold mountain systems in the world, with its geological origins dating back nearly two billion years to the Precambrian era.
- Unlike young fold mountains such as the Himalayas, the Aravallis have undergone extensive weathering and erosion over millions of years, which has reduced them to a series of low-lying hills, ridges, and rocky outcrops rather than sharp peaks.
- This long geological history makes the range a valuable record of early crustal evolution and ancient tectonic processes on the Indian subcontinent.
- Geologically, the Aravallis are composed primarily of metamorphic and igneous rocks, including quartzite, schist, gneiss, marble, and granite. These rock formations are part of the Aravalli–Delhi orogenic belt, which was formed due to ancient tectonic collisions and crustal movements.
- The presence of economically significant minerals such as copper, lead, zinc, gold, and tungsten reflects the complex geological processes that shaped the region. Over time, repeated uplift and denudation exposed these mineral-rich formations at the surface, making the range an important mining zone historically.
- Physically, the Aravalli Range stretches for about 650 kilometres in a south-west to north-east direction, beginning near Palanpur in Gujarat and extending through Rajasthan to Haryana and Delhi.
- The range is discontinuous in nature, with broken hill chains and isolated ridges rather than a continuous mountain wall. Its highest peak is Guru Shikhar in the Mount Abu region of Rajasthan, rising to about 1,722 metres above sea level.
- Moving northwards, the height of the range gradually declines, merging into low hills and rocky terrain around Delhi.
- The Aravallis play a significant role in shaping the physical geography of north-western India. Acting as a natural climatic divide, they influence rainfall patterns by intercepting south-west monsoon winds to a limited extent and preventing the unchecked eastward expansion of the Thar Desert.
- The range also forms an important watershed, giving rise to several seasonal and perennial rivers such as the Chambal, Sabarmati, Luni, and Banas.
- The fractured and porous nature of its rock formations allows rainwater to percolate underground, contributing substantially to groundwater recharge in an otherwise semi-arid region
- The “100-metre definition” of the Aravalli Hills refers to an administrative and legal criterion used—especially in environmental regulation and court proceedings—to identify and protect the Aravalli region.
- Under this definition, any area that rises more than 100 metres above the surrounding plain is treated as part of the Aravalli hill system, irrespective of whether it is a prominent mountain, ridge, or a low, eroded hill. In other words, even subtle elevations and fragmented hillocks that meet this height threshold are classified as Aravalli features.
- This definition became important because the Aravallis are very old and heavily eroded, meaning many sections no longer appear as classic mountains. If protection were limited only to visibly high or continuous hills, large portions of the range—especially in Haryana, Rajasthan, and the Delhi-NCR region—would fall outside legal safeguards.
- The Supreme Court and various environmental authorities have relied on the 100-metre criterion to prevent mining, construction, and land-use change in ecologically sensitive areas of the Aravalli range.
- By using a measurable elevation benchmark rather than appearance alone, the definition helps expand environmental protection to degraded and fragmented parts of the hills
- The Supreme Court’s intervention in the Aravalli region arose from growing concerns over rampant mining, construction, and land-use changes that were degrading this fragile and ancient mountain system.
- One of the core problems identified by the Court was the absence of a uniform and scientifically grounded definition of the Aravalli Hills.
- Different States and authorities were using varying criteria—based on revenue records, forest classification, or visual identification—allowing large tracts of the Aravallis to be excluded from protection and opened up for exploitation.
- To address this ambiguity, the Supreme Court emphasised the need for a uniform definition applicable across States, particularly Rajasthan, Haryana, and Delhi, where the Aravallis are most fragmented and vulnerable.
- The Court endorsed an objective, elevation-based approach, popularly referred to as the “100-metre definition”, under which land rising more than 100 metres above the surrounding plains would be treated as part of the Aravalli hill system.
- This was intended to ensure that even low, eroded, or discontinuous hill formations, which are characteristic of the Aravallis due to their great geological age, are brought within the protective framework.
- Through its interventions, the Supreme Court also linked the protection of the Aravallis to India’s international environmental obligations, particularly under the UN Convention to Combat Desertification (UNCCD).
- The Court observed that the degradation of the Aravalli range could accelerate desertification in north-western India and undermine groundwater recharge, air quality, and regional climate stability.
- Consequently, it directed governments to adopt a consistent and precautionary approach in identifying, mapping, and regulating activities in the Aravalli region
- Since the early 1990s, the Union Environment Ministry has framed regulations permitting mining only in projects that receive official approval, but these safeguards have been widely disregarded.
- In response to persistent violations, the Supreme Court intervened in 2009 and enforced a complete ban on mining activities in Haryana’s Faridabad, Gurugram, and Mewat districts.
- More recently, in May 2024, the Court halted the issuance and renewal of mining leases across the Aravalli range and instructed its Central Empowered Committee (CEC) to carry out an in-depth review. This exercise culminated in a set of recommendations submitted in March 2024.
- The CEC advocated a holistic strategy that called for scientifically mapping the entire Aravalli system across States, conducting a broad-scale environmental impact assessment of mining operations, and enforcing an absolute ban on mining in ecologically fragile zones.
- These included wildlife-protected areas, water bodies, tiger corridors, critical groundwater recharge regions, and locations within the National Capital Region.
- The Committee also stressed the need for tighter controls over stone-crushing units and advised that no fresh mining permissions or lease extensions be granted until comprehensive mapping and impact studies were completed.
- The Supreme Court incorporated these recommendations in its order issued in November 2025.
- In addition, in June 2025, the Union government launched the Aravalli ‘Green Wall’ initiative, aimed at increasing vegetation cover in a five-kilometre buffer zone around the range across 29 districts in Gujarat, Rajasthan, Haryana, and Delhi.
- According to the government, this programme is expected to make a significant contribution towards the restoration of 26 million hectares of degraded land by the year 2030.
The Court observed that earlier instances demonstrate how absolute prohibitions frequently give rise to illegal mining networks, aggressive sand mafias, and uncontrolled resource extraction. Consequently, instead of enforcing a complete shutdown, the Court adopted a balanced strategy—allowing lawful mining operations to proceed under strict oversight, placing a temporary halt on new mining activities until a science-based framework is developed, and keeping ecologically critical zones permanently closed to mining

- In September 2022, NCST Chairperson Harsh Chouhan shot off a letter to Environment Minister Bhupendra Yadav, highlighting the potential consequences of FCR, 2022, recommending that they be put on hold and the previous Rules, which provided for the consent clause, be strengthened.
- The ST panel argued that the previous versions of the Rules provided a legal space for ensuring the completion of the processes for recognition and vesting of rights under the FRA in areas where forests are being diverted.
- The ST Commission noted that it made little sense to take the consent of tribals and forest dwellers after an applicant had got Stage 1 clearance.

By then, the applicant would be invested in the project and would then have the incentive to "pursue the State It said governments or Union Territories" to divert the land at the earliest.
The NCST added that the FCR, 2022 provided for compensatory Afforestation, but nowhere did it prescribe safeguards or a mechanism for compliance with FRA.

- Further, the NCST's Working Group found that FRA compliance was in trouble even under the old rules.
It said currently, nearly 25, 000-30, 000 hectares of forest land were being diverted every year. - It cited a study by the Centre for Environment and Development, ATREE to note: " Out of 128 applications for forest diversion for mining, over 100 had been processed between 2009 and 2018".
- It added that 74 proposals had Stage 2 approval, 46 had Stage 1 approval (in principle), with just five rejected and four closed for other reasons.
- None of the rejections was for non-compliance with FRA.
- The study also found that 14 of these cases (all post-2014) had been cleared with an FRA compliance report, despite, this being far from the "ground reality".
5. About NCST
- The National Commission for Scheduled Tribes is a constitutional body that was established by the Constitution (89th Amendment) Act, 2003.
- The Commission is an authority working for the economic development of Scheduled Tribes in India.

Article 366 (25) of the Constitution, Scheduled Tribes are those communities that are scheduled in by article 342 of the Constitution.
Also, Article 342 of the Constitution says that: The Scheduled Tribes are the tribes or tribal communities or part of or groups within these tribes and tribal communities which have been declared as such by the President through a public notification.

5.1. Composition of NCST
- The NCST consists of one chairperson, one vice-chairperson and three full-time members.
- Out of the three members, there should compulsorily be one lady member.
- Tenure of the members is 3 years.
5.2. Functions of NCST
- It investigates and monitors issues related to safeguarding the provisions for Scheduled Tribes under the Constitution and evaluating the working of those safeguards.
- NCST will inquire into specific complaints concerned with the deprivation of rights and safeguards of the STs.
- The commission participates and advises on the planning process for the socio-economic development of the STs and also evaluates the progress of the various developmental activities.
- The President will be presented with an annual report on the working of those safeguards.
- Apart from annual reports, other reports also will be submitted to the President as and when necessary.
- The Commission will also give reports on what measures are to be taken by both the central and various state governments for the effective execution of the measures and safeguards for the protection, development and welfare of the STs.
- Other functions of NCST are related to the welfare, protection, development and advancement of the STs.
6. Forest Rights Act
- The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, commonly known as the Forest Rights Act of India, is often referred to as the Tribal Rights Act or the Tribal Land Act.
- It was enacted in 2006 and recognises the rights of tribal communities that live in the forest as well as other traditional forest dwellers to the forest resources that were essential to their ability to provide for a variety of needs, including subsistence, habitation and other sociocultural requirements.
- The forest management policies, including the Acts, Rules and Forest Policies of Participatory Forest Management policies in both colonial and post-colonial India, did not, till the enactment of this Act., recognize the symbiotic relationship of the STs with the forests, reflected in their dependence on the forests as well as in their traditional wisdom regarding conservation of the forests.
| The Act encompasses Rights of Self-cultivation and Habitation which are usually regarded as Individual rights; and Community Rights such as Grazing, Fishing and access to Water bodies in the forest, Habitat Rights for PVTGs, Traditional Seasonal Resources access to Nomadic and Pastoral Communities, access to biodiversity, community right to intellectual property and traditional knowledge, recognition of traditional customary rights and right to protect, regenerate or conserve or manage any community forest resource for sustainable use. |
- It also provides rights to the allocation of forest land for developmental purposes to fulfil the basic infrastructural needs of the community.
- In conjunction with the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Settlement Act, 2013 FRA protects the tribal population from eviction without rehabilitation and settlement.

The Act further enjoins upon the Gram Sabha and rights holders the responsibility of conservation and protection of bio-diversity, wildlife, forests, adjoining catchment areas, water sources and other ecologically sensitive areas as well as to stop any destructive practices affecting these resources or cultural and natural heritage of the tribals.The Gram Sabha is also a highly empowered body under the Act, enabling the tribal population to have a decisive say in the determination of local policies and schemes to impact them.

Thus the Act empowers the forest dwellers to access and use the forest resources in the manner that they were traditionally accustomed, to protect, conserve and manage forests, protect forest dwellers from unlawful evictions and also provides for basic development facilities for the community of forest dwellers to access facilities of education, health, nutrition, infrastructure etc.

- To ensure land tenure, livelihood and food security of the forest-dwelling Scheduled Tribes and other traditional forest dwellers

- Article 324(1) of the Indian Constitution empowers the Election Commission of India (ECI) with the authority to oversee, guide, and manage the preparation of electoral rolls as well as the conduct of elections for both Parliament and the State Legislatures.

- China has imposed restrictions on the export of seven rare earth elements (REEs) — dysprosium, gadolinium, lutetium, samarium, scandium, terbium, and yttrium — which are part of the 17 REEs.
- The country dominates the global refining of heavy REEs, giving it substantial control over critical supply chains, ranging from consumer electronics to defense. Although these measures do not constitute a complete export ban, they may cause temporary supply disruptions, as exporters navigate the permit process.
- India may not face an immediate disruption due to these restrictions. Despite government efforts to enhance domestic manufacturing of semiconductors and defense systems, the more sophisticated phases of production largely take place abroad, particularly in China and Japan. Japan, in anticipation of such issues, has already built stockpiles to buffer against REE-related supply shocks.
- Recognizing the strategic importance of REEs, India is aware that it holds around 6% of global deposits. However, the country’s capacity for mining and refining is minimal, largely due to the environmental challenges associated with such operations.
- India does extract some light REEs through its state-run firm, Indian Rare Earths Ltd, including monazite from coastal sands in Kerala. Nonetheless, imports still play a role.
- According to a recent statement by the Ministry of Mines in the Lok Sabha, India imported approximately 2,270 tonnes of REEs in 2023–24. Consequently, the national approach involves a mix of increasing domestic output and maintaining import channels
To support the strategic use of essential resources such as rare earth elements, India has launched the National Critical Mineral Mission (NCMM). This initiative aims to strengthen the country’s supply chain for critical minerals by boosting domestic production and establishing alternative international supply partnerships. According to a presentation by the Ministry of Mines in January, global events like China’s export restrictions, the Russia–Ukraine conflict, and other geopolitical factors have exposed vulnerabilities in the global critical mineral supply, underscoring the urgency of diversifying sources.
As part of the NCMM, the Indian government plans to oversee or support around 1,200 mineral exploration projects. It also intends to offer exploration licenses to encourage private sector participation and conduct auctions for additional critical mineral blocks
