KATCHATHEEVU ISLAND 

 
 
 
1. Context 
 
PRIME MINISTER Narendra Modi on Friday met visiting Sri Lanka Prime Minister Harini Amarasuriya, and discussed education, women’s empowerment, innovation, development cooperation and welfare of fishermen
 
 

2. Location of Katchatheevu Island

Katchatheevu is a small, uninhabited island covering 285 acres situated in the Palk Strait, positioned between India and Sri Lanka. It measures approximately 1.6 kilometres in length and slightly over 300 meters wide at its widest point.

  • The island is located northeast of Rameswaram, around 33 kilometres from the Indian coastline. It is situated approximately 62 kilometres southwest of Jaffna, which is at the northern tip of Sri Lanka. Moreover, Katchatheevu is about 24 kilometres away from Delft Island, an inhabited island that belongs to Sri Lanka.
  • The notable feature on Katchatheevu Island is the St. Anthony’s Church, built in the early 20th century. This Catholic shrine holds cultural and religious importance, especially during its annual festival. Christian priests from both India and Sri Lanka conduct services during this festival, attracting devotees from both countries who make pilgrimages to the island. In 2023, around 2,500 Indians travelled from Rameswaram to participate in this significant event.
  • Despite its religious and cultural significance, Katchatheevu is not suitable for permanent human settlement due to the absence of a reliable source of drinking water on the island. This limitation restricts any long-term habitation on the island, making it primarily a site for occasional religious gatherings and pilgrimages.

 

3. Historical Background of Katchatheevu Island

Katchatheevu Island, formed as a result of a volcanic eruption in the 14th century, holds a relatively recent place in the geological timeline.

  • During the early medieval period, Katchatheevu was under the control of the Jaffna kingdom of Sri Lanka. However, by the 17th century, control shifted to the Ramnad Zamindari, which was based in Ramanathapuram, approximately 55 kilometres northwest of Rameswaram.
  • With the advent of colonial rule, Katchatheevu became part of the Madras Presidency under the British administration. In 1921, both India and Sri Lanka, then British colonies, laid claim to Katchatheevu to delineate fishing boundaries in the region.
  • A survey conducted during this period marked Katchatheevu as part of Sri Lanka. However, a British delegation from India contested this claim, asserting ownership of the island by the Ramnad kingdom.
  • The dispute over the ownership of Katchatheevu persisted until 1974 when a final resolution was reached. This resolution marked a significant milestone in clarifying the status of the island and delineating the maritime boundaries between India and Sri Lanka.

 

4. Indo-Sri Lankan Maritime Agreement and Fishing Rights

In 1974, efforts were made by then-Prime Minister Indira Gandhi to resolve the maritime border dispute between India and Sri Lanka permanently. This initiative led to the establishment of the 'Indo-Sri Lankan Maritime Agreement,' which resulted in the cession of Katchatheevu to Sri Lanka by India.

  • Under the agreement, Indira Gandhi decided to "cede" Katchatheevu to Sri Lanka, perceiving the island to hold little strategic value for India. This move was intended to strengthen diplomatic ties between the two neighbouring countries.
  • Despite ceding the island, Indian fishermen were granted continued access to Katchatheevu as per the agreement, maintaining their traditional fishing practices in the region. However, the agreement did not explicitly address the issue of fishing rights, leading to subsequent challenges and differing interpretations.
  • Sri Lanka interpreted Indian fishermen's access to Katchatheevu as limited to activities such as resting, drying nets, and visiting the Catholic shrine, without requiring a visa. This interpretation created ambiguity regarding the extent of fishing rights granted to Indian fishermen in the waters surrounding Katchatheevu.
  • In 1976, another agreement during India's Emergency period further complicated matters by prohibiting both countries from fishing in each other's Exclusive Economic Zones (EEZs). However, Katchatheevu lies at the boundary of both countries' EEZs, adding to the uncertainty surrounding fishing rights and activities in the region.
  • The agreements made in the 1970s regarding Katchatheevu and fishing rights have left unresolved issues, contributing to periodic tensions and disputes between Indian fishermen and Sri Lankan authorities. The lack of clear delineation and mutual understanding regarding fishing access around Katchatheevu continues to be a contentious issue between India and Sri Lanka.

5. Impact of the Sri Lankan Civil War on Katchatheevu

The period between 1983 and 2009 was marked by the Sri Lankan Civil War, during which the border dispute involving Katchatheevu took a back seat amidst the intense conflict.

  • During the civil war, Sri Lankan naval forces were primarily focused on combating the Liberation Tigers of Tamil Eelam (LTTE) based in Jaffna. This preoccupation allowed Indian fishermen to venture deep into Sri Lankan waters without significant repercussions. Incursions by Indian fishermen, especially using larger trawlers, became common during this time. These activities led to tensions as they not only overfished but also caused damage to Sri Lankan fishing equipment and vessels.
  • The end of the civil war in 2009 brought about significant changes. Sri Lanka bolstered its maritime defences and shifted its attention to issues such as illegal fishing activities by Indian fishermen.
  • Indian fishermen, facing resource depletion in Indian waters, continued to venture into Sri Lankan waters as they had done for years. However, with increased surveillance and stricter enforcement post-civil war, they began facing arrests and other consequences by the Sri Lankan navy.
  • To this day, the Sri Lankan navy regularly apprehends Indian fishermen for illegal fishing activities in Sri Lankan waters. Incidents of alleged custodial torture and deaths have also been reported, further complicating the situation. Each such incident reignites demands to revisit the issue of Katchatheevu and its impact on fishing rights and maritime boundaries between India and Sri Lanka. The historical context of the island's ownership and fishing rights continues to be a source of contention and debate between the two nations.

 

6. Tamil Nadu's Stance on Katchatheevu

The issue of Katchatheevu holds significant political and emotional weight in Tamil Nadu, with successive governments and leaders advocating for its retrieval and the restoration of fishing rights for Tamil fishermen.

  • The decision to "cede" Katchatheevu to Sri Lanka in 1974 without consulting the Tamil Nadu state assembly sparked immediate protests. This decision was seen as infringing on traditional fishing rights and livelihoods of Indian Tamil fishermen, given the historical ties of the Ramnad Zamindari to the island.
  • The Tamil Nadu Assembly has consistently demanded the retrieval of Katchatheevu and the restoration of fishing rights. Leaders like J Jayalalitha and MK Stalin, among others, have actively pursued this agenda through legal and diplomatic channels.
  • In 2008, Jayalalitha filed a petition arguing that ceding Katchatheevu required a constitutional amendment and had adversely affected fishermen's rights. Similar efforts were made by other leaders, including appeals to the Supreme Court.
  • Despite Tamil Nadu's persistent demands, the Union government's stance has remained unchanged. It asserts that since Katchatheevu has been under dispute historically, no territorial or sovereignty claims were ceded.
  • While there is vocal demand for Katchatheevu's retrieval, practical challenges hinder such efforts. The Union government has pointed out that revisiting Katchatheevu's status would require drastic measures, potentially leading to diplomatic complexities or conflict.

 

7. The Way Forward
 
Resolving the Katchatheevu issue requires a delicate approach that acknowledges historical claims, addresses Tamil Nadu's concerns, and prioritises peaceful coexistence with Sri Lanka. Open communication, diplomatic efforts, and a focus on mutually beneficial solutions like designated fishing zones or joint patrols hold promise for a sustainable resolution.

UTTARAKHAND'S UNIFORM CIVIL CODE

Following a clutch of petitions challenging the Uniform Civil Code Act, 2023, and UCC Rules, 2024, the Uttarakhand government’s Home Department on Wednesday submitted an affidavit proposing amendments to the rules manual at the High Court

2. The objective of a Uniform Civil Code (UCC) in India

  • A Uniform Civil Code (UCC) aims to establish a consistent set of laws to replace the diverse personal laws associated with different religions. These laws pertain to crucial aspects like marriage, divorce, adoption, and inheritance. The constitutional basis for the UCC is found in Article 44, which directs the state to "endeavour to secure for the citizens a uniform civil code throughout the territory of India." This provision falls under the Directive Principles of State Policy, playing a significant role in governance, even though it is not legally enforceable.
  • The inclusion of the UCC provision sparked intense debates during the deliberations of India's Constituent Assembly. There was a profound discussion on whether it should be considered a fundamental right or a directive principle. Opponents raised concerns that implementing a UCC might compromise the rights of religious minorities and erode India's cultural diversity. Some argued that it could conflict with the freedom of religion guaranteed under Article 19 (now Article 25) of the draft Constitution.
  • While some, like Member K.M. Munshi, advocated for the UCC, emphasizing its potential to promote gender equality and eliminate discriminatory practices against women, others, like Member Naziruddin Ahmad, expressed reservations. Ahmad highlighted the need for community consent for implementing such a uniform set of laws.
  • Dr. B.R. Ambedkar, taking a more ambivalent stance, expressed the desirability of a UCC but recommended that it be "purely voluntary" in its initial stages. He argued that since the provision was recommendatory and not mandatory, it should not be imposed on all citizens.
  • The matter was ultimately settled with a 5:4 majority vote, led by the sub-committee on fundamental rights headed by Sardar Vallabhbhai Patel. The decision was that the establishment of a UCC should not be categorized as a fundamental right.

3. Development of Uttarakhand's Uniform Civil Code (UCC)

  • In June 2022, the Uttarakhand government established an expert committee led by former Supreme Court judge Justice Ranjana Prakash Desai to explore avenues for implementing a Uniform Civil Code (UCC). This initiative to implement a UCC in the state if re-elected. Despite the Chief Minister's announcement in June of that year that a draft UCC was prepared, the committee faced delays in submitting its report. The original deadline in November 2022 was extended multiple times.
  • Right from the outset, the proposal encountered opposition from rival political parties, with Congress representatives in the state claiming that the UCC initiative was merely a political strategy to influence voters in the lead-up to the general elections. The tribal community, constituting 2.9% of the population, had not given consent to the UCC. Additionally, the Van Gujjar tribe, a Muslim nomadic group with around 60,000 members, expressed concerns about the proposed law.
  • The controversies surrounding community consent and political motivations added complexity to the discussions surrounding the proposed implementation of the UCC in the state.

4. Anticipated Changes in Uttarakhand's Uniform Civil Code (UCC)

  • The forthcoming draft of the Uniform Civil Code (UCC) in Uttarakhand is poised to bring about significant changes, primarily focusing on gender equality within legal frameworks. Notable provisions include equal treatment of men and women, particularly in matters related to inheritance. The UCC is expected to eliminate practices associated with marriage and divorce, such as polygamy, iddat (mandatory waiting period for women after the dissolution of a Muslim marriage), and triple talaq. Furthermore, the proposed Code is likely to ensure an equal property share for Muslim women, surpassing the current 25% share stipulated by Muslim personal law.
  • Despite these amendments, the minimum age for marriage is anticipated to remain unchanged, with 18 years for women and 21 years for men. The UCC is set to encompass a range of issues, including divorce, marriage registrations, adoption, and provisions for the social security of ageing parents. Additionally, the committee has recommended the mandatory registration of live-in relationships.
  • In clarifying the intentions behind the UCC, the proposed changes are not geared towards appeasing any specific community but rather aim to empower all sections of society. The implementation of the UCC would not impact reservations, marital rights, customs, or any other class-specific considerations. The emphasis is on fostering equality and empowerment across diverse segments of the population.

5. Supreme Court's Stance on Uniform Civil Code (UCC) and Related Petitions

Over the years, the Supreme Court has engaged in discussions on the Uniform Civil Code (UCC) through various judgments. However, it has consistently refrained from issuing directives to the government, emphasizing that law-making falls exclusively within the domain of Parliament. In the 1985 Shah Bano Begum case, the Court expressed regret over Article 44 remaining a "dead letter" and urged its implementation. This sentiment was echoed in subsequent cases like Sarla Mudgal versus Union of India (1995) and John Vallamattom versus Union of India (2003).

Petitions for Uniformity in Laws

Between 2021 and 2022, six petitions were filed in the Supreme Court seeking uniformity in divorce, maintenance, and alimony laws, asserting that existing laws discriminated against women and thereby violated constitutional provisions under Article 14 (right to equality) and Article 15 (right against discrimination based on religion and gender). In March of the previous year, a Bench led by Chief Justice of India (CJI) D.Y. Chandrachud dismissed these petitions, emphasizing that such matters are within the exclusive legislative purview of Parliament.

Dismissal of Petition Challenging Uttarakhand's UCC Committee

In January of the same year, the Supreme Court dismissed a petition challenging the Uttarakhand government's establishment of an expert committee on the UCC. The Court highlighted that Article 162 permits the exercise of executive powers, stating, "Article 162 of the Constitution indicates that the executive power of a State extends to matters concerning which the Legislature of the State has power to make laws." The order emphasized that the constitution of such a committee, as per Entry 5 of the Concurrent List, dealing with "marriage and divorce; infants and minors; adoption; wills, intestacy, and succession," could not be challenged as ultra vires.


6. Law Commission's Perspective on the Uniform Civil Code (UCC)

  • In 2016, the government sought the Law Commission of India's guidance on formulating a Uniform Civil Code (UCC) due to the diverse personal laws existing in the country. In response, the 21st Law Commission, led by former Supreme Court judge Justice Balbir Singh Chauhan, submitted a 185-page consultation paper in August 2018 titled "Reforms of family law." The paper concluded that, at that stage, the formulation of a UCC was deemed "neither necessary nor desirable." It emphasized that a unified nation did not inherently require "uniformity" and that secularism should not contradict the diverse cultural and religious practices prevailing in the country. While rejecting the immediate need for a UCC, the commission recommended amendments to eliminate discriminatory practices and stereotypes present in the existing personal laws.
  • On June 14 of the following year, the 22nd Law Commission, led by Justice (Retd) Rituraj Awasthi, issued a notification seeking input from various stakeholders, including the public and religious organizations, on the UCC. Notably, Justice Awasthi, during his tenure as Chief Justice of the Karnataka High Court, had ruled in favour of the Karnataka government's order prohibiting the wearing of hijab in educational institutions.
  • The Law Commission's transition from deeming a UCC as unnecessary in 2018 to actively seeking public opinion in 2022 signifies a shift in perspective. While the 2018 report emphasized the importance of maintaining cultural and religious diversity, the subsequent move to engage stakeholders suggests a willingness to reconsider and evaluate the need for a UCC, taking into account diverse viewpoints and societal changes.

7. Future Developments in the Uniform Civil Code (UCC) Landscape

  • Following Uttarakhand's lead, Madhya Pradesh and Gujarat have also established committees to kickstart the formulation of a Uniform Civil Code (UCC). This push for a UCC was included in the BJP's election manifesto for the Karnataka Assembly polls, although the Congress eventually secured a significant victory in that election.
  • The question of whether the central government will propose a UCC on a pan-India level remains a topic of debate. The central government will likely proceed cautiously, observing the outcomes of the initiatives undertaken by individual states. The awaited report from the 22nd Law Commission is anticipated to carry persuasive weight in shaping the discourse.
  • The renewed momentum towards a UCC may also be influenced by a pending query before the Supreme Court concerning the "scope and ambit of the right to freedom of religion under Article 25 of the Constitution." This question originated in the Sabarimala case and was framed by a Constitution Bench for reference to a larger bench. Despite three years passing, there has been no substantial progress on this matter.
  • The evolving landscape of UCC initiatives in various states, coupled with the legal and political considerations at the national level, indicates a complex and dynamic situation. The outcome of these state-level efforts, coupled with the pending Supreme Court query, will likely influence the trajectory of discussions on the UCC at both the state and national levels. The UCC debate continues to be shaped by legal, political, and societal dynamics, with potentially far-reaching implications for India's legal framework and cultural diversity.

RARE EARTH ELEMENTS

 
 
1.Context
 
Last Thursday, China ramped up the clampdown on its rare earth exports, prompting US President Donald Trump to threaten economic retaliation by way of 100% tariffs. Trump also suggested that he could cancel a scheduled meetup with Chinese President Xi Jinping on the sidelines of the Asia-Pacific Economic Cooperation Leaders’ Meeting in South Korea later this month, although he toned down his rhetoric just hours later.
 
2.About rare earth metals
 
Rare earth elements or rare earth metals are a set of 17 chemical elements in the periodic table  the 15 lanthanides, plus scandium and yttrium, which tend to occur in the same ore deposits as the lanthanides, and have similar chemical properties
 
The 17 rare earths are cerium (Ce), dysprosium (Dy), erbium (Er), europium (Eu), gadolinium (Gd), holmium (Ho), lanthanum (La), lutetium (Lu), neodymium (Nd), praseodymium (Pr), promethium (Pm), samarium (Sm), scandium (Sc), terbium (Tb), thulium (Tm), ytterbium (Yb), and yttrium (Y)

3.Applications of rare earths
  • These elements are important in technologies of consumer electronics, computers and networks, communications, clean energy, advanced transportation, healthcare, environmental mitigation, and national defence, among others
  • Scandium is used in televisions and fluorescent lamps, and yttrium is used in drugs to treat rheumatoid arthritis and cancer
  •  Rare earth elements are used in space shuttle components, jet engine turbines, and drones
  • Cerium, the most abundant rare earth element, is essential to NASA’s Space Shuttle Programme
  • In recent years, rare earths have become even more important because there has been an increase in demand for green energy
  • Elements like neodymium and dysprosium, which are used in wind turbine motors, are sought-after more than ever as wind mills across the world continue to grow
  • Moreover, the push for switching from internal combustion cars to electric vehicles has also led to a rise in demand for rare earth magnets made from neodymium, boron, and iron and batteries
 
 4. China's export restrictions and impact on India
 
  • China has imposed restrictions on the export of seven rare earth elements (REEs) — dysprosium, gadolinium, lutetium, samarium, scandium, terbium, and yttrium — which are part of the 17 REEs.
  • The country dominates the global refining of heavy REEs, giving it substantial control over critical supply chains, ranging from consumer electronics to defense. Although these measures do not constitute a complete export ban, they may cause temporary supply disruptions, as exporters navigate the permit process.
  • India may not face an immediate disruption due to these restrictions. Despite government efforts to enhance domestic manufacturing of semiconductors and defense systems, the more sophisticated phases of production largely take place abroad, particularly in China and Japan. Japan, in anticipation of such issues, has already built stockpiles to buffer against REE-related supply shocks.
  • Recognizing the strategic importance of REEs, India is aware that it holds around 6% of global deposits. However, the country’s capacity for mining and refining is minimal, largely due to the environmental challenges associated with such operations.
  • India does extract some light REEs through its state-run firm, Indian Rare Earths Ltd, including monazite from coastal sands in Kerala. Nonetheless, imports still play a role.
  • According to a recent statement by the Ministry of Mines in the Lok Sabha, India imported approximately 2,270 tonnes of REEs in 2023–24. Consequently, the national approach involves a mix of increasing domestic output and maintaining import channels
 
5. Way Forward
 

To support the strategic use of essential resources such as rare earth elements, India has launched the National Critical Mineral Mission (NCMM). This initiative aims to strengthen the country’s supply chain for critical minerals by boosting domestic production and establishing alternative international supply partnerships. According to a presentation by the Ministry of Mines in January, global events like China’s export restrictions, the Russia–Ukraine conflict, and other geopolitical factors have exposed vulnerabilities in the global critical mineral supply, underscoring the urgency of diversifying sources.

As part of the NCMM, the Indian government plans to oversee or support around 1,200 mineral exploration projects. It also intends to offer exploration licenses to encourage private sector participation and conduct auctions for additional critical mineral blocks

  • This is significantly lower than the 1.59 degree Celsius rise for land temperatures across the world. It could give the impression that the problem of climate change in India was not as acute as in other parts of the world. But that is not entirely accurate. 

3. Why is warming over India is lower?

  • The relatively lower rise in temperatures over India is not a surprise. Also, India is not a special case. The increase in temperatures is known to be more prominent in the higher altitudes, near the polar regions, than near the equator.
  • This is attributable to a complex set of atmospheric phenomena, including heat transfers from the tropics to the poles through prevailing systems of air circulation. India happens to be in the tropical region, quite close to the equator.
  • A substantial part of the difference between the temperature rise over India and that over the entire world can be explained by understanding what the different numbers represent. 
  • The planet as a whole has warmed by 1.1 degree Celsius compared with preindustrial times.
  • But, as mentioned earlier, this is just the average. Different regions have seen very different levels of warming.
  • The polar regions, particularly the Arctic, have seen significantly greater warming. The IPCC report says the Arctic region has warmed at least twice as much as the world average.
  • Its current annual mean temperatures are about 2 degrees Celsius higher than pre-industrial times. Some other studies suggest the Arctic could be warming even faster.
  • Again, this happens because of a variety of reasons, including the processes mentioned earlier. Another prominent cause is what is known as the albedo effect, or how much sunlight a surface reflects. The ice cover in the Arctic is melting, because of which more land or water is getting exposed to the Sun.
  • Ice traps the least amount of heat and reflects most of the solar radiation when compared with land or water.
  • More recent research suggests that the higher warming in the polar region could be attributed to a host of factors, including the albedo effect, changes in clouds, water vapour, and atmospheric temperatures.
  • The warming in the polar regions accounts for a substantial part of the 1.1-degree Celsius temperature rise over the entire globe. 

4. Higher warming over land than oceans

  • However, the 0.7 degree Celsius temperature rise over India has to be compared with the warming seen over land areas, not the entire planet.
  • As mentioned, land areas have become warmer by 1.59 degree Celsius. Land areas tend to get heated faster and by a larger amount, than oceans.
  • Daily and seasonal variations in heating over land and oceans are usually explained in terms of their different heat capacities. Oceans have a higher capacity to cool themselves down through the process of evaporation.
  • The warmer water evaporates, leaving the rest of the ocean relatively cooler. However, longer-term enhanced heating trends over land have to be attributed to other, more complicated, physical processes involving land-ocean-atmospheric interactions.

5. Impact of Aerosols

  • Aerosols refer to all kinds of particles suspended in the atmosphere. These particles have the potential to affect the local temperature in multiple ways.
  • Many of these scatter sunlight back, so that lesser heat is absorbed by the land. Aerosols also affect cloud formation.
  • Clouds, in turn, have an impact on how much sunlight is reflected or absorbed.
    Aerosol concentration in the Indian region is quite high, due to natural as well as man-made reasons.
  • Due to its location in the tropics and the arid climate, India is no stranger to dust. But it also happens to be experiencing heavy pollution right now.
  • Emissions from vehicles, industries, construction, and other activities add a lot of aerosols to the Indian region. A reduction in warming could be an unintended but positive side effect.

AIR QUALITY INDEX (AQI)

 

1. Context

Delhi recorded a daily average Air Quality Index (AQI) of 296 i.e. ‘Poor’ category, as per the daily AQI Bulletin provided by the Central Pollution Control Board (CPCB). Delhi’s hourly average AQI rose to 300 at 6PM and further rose to 302 at 7 PM i.e. ‘Very Poor’ category, prompting the Sub-Committee on the Graded Response Action Plan (GRAP) of the Commission for Air Quality Management in NCR and Adjoining Areas (CAQM) to immediately call a meeting to review the current air quality scenario and weather/ meteorological conditions. 
 

2. The Air Quality Index (AQI)

The AQI is a colour-coded index launched under the Swachh Bharat campaign to simplify the understanding of pollution levels. It helps convey the condition of the air and guides appropriate measures based on the severity of pollution. The AQI consists of six categories, each with a corresponding colour code: 'Good' (0-50), 'Satisfactory' (51-100), 'Moderately Polluted' (101-200), 'Poor' (201-300), 'Very Poor' (301-400) and 'Severe' (401-500).

3. Calculation of AQI

  • To calculate the AQI, a technical study was conducted by an expert group, including medical professionals, air quality experts, and academics.
  • Various pollutants, such as PM10, PM2.5, Nitrogen Dioxide, Ozone, Carbon, and others, are measured.
  • Each pollutant is assigned a weight based on its impact on human health.
  • The composite air quality index is determined by combining these weights, simplifying multiple data points into a single number and colour to represent overall air quality.
  • Monitoring stations across the country assess these pollutant levels.

4. Impact of Pollutants on Health

  • Among the most harmful pollutants are fine particulate matter, such as PM2.5, which has a diameter smaller than 2.5 micrometres.
  • PM2.5 particles can easily enter the circulatory system, bypassing the nose and throat.
  • They are associated with respiratory problems and reduced visibility, posing health risks such as asthma, heart attacks, bronchitis, and other respiratory issues.

5. Influence on Government Policy

  • Governments, especially in areas like Delhi, use the AQI to announce measures to combat air pollution.
  • When the AQI in the National Capital Region (NCR) reaches the 'severe' category, Stage 4 of the Graded Response Action Plan (GRAP) is implemented.

2. Election Commission of India (ECI)
 
  • The Election Commission of India (ECI) is a permanent and independent constitutional body tasked with ensuring the conduct of free and fair elections across the Union and States of India.
  • The ECI has the authority to supervise, direct, and manage elections to the Parliament, state legislatures, and the offices of the President and Vice President of India. However, since the ECI does not manage elections for state-level urban bodies such as municipalities and panchayats, a separate State Election Commission exists for this purpose.
  • Notably, based on Dr. B. R. Ambedkar's guidance at the Constituent Assembly, a committee tasked with addressing Fundamental Rights suggested that the independence of elections and the protection from executive interference in legislative elections should be considered a fundamental right and included in the chapter on Fundamental Rights.
  • While the idea was generally accepted, some members proposed that it be placed in a different section of the Constitution. Consequently, the Drafting Committee, following the House's decision, moved this provision from the Fundamental Rights chapter to another part of the Constitution
 
3. Constitution and Election Commission of India
 

The Constitution includes a series of articles (Articles 324–329) that grant powers to the Election Commission and outline its possible roles and responsibilities.

  • Article 324: Grants the authority for overseeing, directing, and controlling the preparation of electoral rolls and the conduct of all elections to Parliament, state legislatures, and the offices of the President and Vice-President.

4. ECI Responsibilities and Functions
 

The responsibilities and functions of the Election Commission of India (ECI) can be categorized into advisory, quasi-judicial, and administrative roles.

  • Advisory: The Constitution grants the ECI the authority to advise on the post-election disqualification of sitting members of Parliament and State Legislatures. The ECI is also consulted in cases where individuals are found guilty of corrupt practices during elections, as brought before the Supreme Court and High Courts, to decide if they should be disqualified from contesting future elections and for how long. In such matters, the President or, where applicable, the Governor, is required to follow the ECI's advice.
  • Quasi-Judicial: The ECI has the power to disqualify a candidate who fails to submit their election expense accounts within the legally required timeframe and format. It also has the authority to remove or reduce other legal disqualifications. Additionally, the ECI resolves disputes related to the recognition of political parties and the allocation of election symbols. The commission sets a model code of conduct and ensures compliance by all candidates and political parties during elections.
  • Administrative: The ECI's administrative duties include delimiting electoral constituencies and managing the registration of eligible voters, as well as regularly updating electoral rolls. The commission is responsible for announcing election schedules and dates, reviewing nomination documents, recognizing political parties, and assigning them election symbols. The ECI can also nullify voting in cases of violence, booth capturing, tampering, or other irregularities. It oversees the financial expenditure of political parties on candidates' campaigns impartially.

The ECI also designates specific roles to register political parties for elections and grants them the status of national or state parties based on their performance in the polls. These roles include the person in charge of elections, the District Election Officer, and the Election Registration and Returning Officer

 

5. Composition of Election Commission of India

  • Since its inception in 1950, the Chief Electoral Commissioner (CEC) was the sole member of the Election Commission of India (ECI). However, after the voting age was lowered from 21 to 18 in 1989, a large influx of new voters was added. To manage this increased workload, two additional commissioners were appointed, expanding the ECI to include three commissioners.
  • In January 1990, some changes were made to the structure of the ECI, but it was soon reverted to its original form. Following discussions and debates in the political sphere, the President ultimately reconstituted the commission in 1993, adding two more commissioners, establishing the current structure of the ECI.
  • The Chief Election Commissioner and the other election commissioners are appointed by the President, who also determines their terms of office and service conditions. All commissioners, including the CEC, receive the same salary, benefits, and powers as judges of the Supreme Court.
  • If there is a disagreement among the three members, decisions are made by a majority vote. Commissioners serve a term of up to six years or until they reach the age of 65, whichever comes first. They hold a status equivalent to that of Supreme Court justices in India.
  • The Chief Election Commissioner can only be removed from office through the same process used to remove a Supreme Court judge. This involves the President dismissing the CEC based on a resolution supported by a special majority in both Houses of Parliament, on grounds of proven misconduct or incapacity.
  • In conclusion, as outlined by the Constitution, the ECI is responsible for supervising, directing, and conducting elections for the offices of President, Vice President, state legislatures, and Parliament.

A landslide is a geological phenomenon involving the movement of a mass of rock, earth, or debris down a slope. Landslides can occur due to various factors, including natural processes and human activities

3. Landslides in India
  • The recent cases of land subsidence in Joshimath, Uttarakhand, captured the spotlight.
  • On June 29, 2022, at least 79 people were killed in a landslide in the Noney district of Manipur.
  • The risk analysis in the report was based on the density of human and livestock populations, which indicates the impacts on people due to these landslides.
  • The disaster in Kedaranath in 2013 and the landslides caused by the devastating Sikkim earthquake in 2011 are also included in this atlas.
Between 1988 and 2022, the maximum number of landslides 12, 385 recorded in Mizoram.
Uttarakhand followed it at 11, 219, Tripura at 8, 070, Arunachal Pradesh at 7, 689, and Jammu and Kashmir at 7,280. Kerala saw 6,039, Manipur 5,494 and Maharashtra recorded 5, 112 incidents of landslides.
 
  • Globally, landslides rank third in terms of deaths among natural disasters.
  • However, deforestation due to unplanned urbanisation and human greed increases the risk of such incidents.
  • In 2006, about 4 million people were affected by landslides, including a large number of Indians.
  • India is among the four major countries where the risk of landslides is the highest; it added. If we look at the figures, about 0.42 million square kilometres in the country are prone to landslides, which is 12.6 per cent of the total land area of the country.
  • However, the figure does not include snow-covered areas. Around 0.18 million sq km of landslide-prone areas in the country are in North East Himalayas, including Darjeeling and Sikkim Himalayas.
  • Of the rest, 0.14 million sq km falls in North West Himalaya (Uttarakhand, Himachal Pradesh and Jammu and Kashmir); 90, 000 sq km in the Western Ghats and Konkan hills (Tamil Nadu, Kerala, Karnataka, Goa and Maharashtra) and 10, 000 sq km in Eastern Ghats of Aruku in Andhra Pradesh.

4. Reasons for landslides

  • Sudden heavy rains due to climate change are also increasing landslides. Around 73 per cent of landslides in the Himalayan region are attributed to heavy rains and reduced water-absorbing capacity of the soil.
  • Global climate change is causing heavy rainfall that erodes steep slopes with loose soil found in a 2020 study by the Indian Institute of Technology in Delhi.
  • Therefore, the increasing number of landslides can no longer be termed as just natural disasters, as human actions have also played a major role in it.
5. Data On Landslides
  • Uttakarkhand, Kerala, Jammu and Kashmir, Mizoram, Tripura, Nagaland and Arunachal Pradesh reported the highest number of landslides during 1998 – 2022
  • Mizoram topped the list, recording 12,385 landslide events in the past 25 years, of which 8,926 were recorded in 2017 alone
  • Likewise, 2,071 events of the total 2,132 landslides reported in Nagaland during this period occurred during the 2017 monsoon season
  • Manipur, too, showed a similar trend, wherein 4,559 out of 5,494 landslide events were experienced during the rainy season of 2017, Of the total 690, Tamil Nadu suffered 603 landslide events in 2018 alone
  • Among all these states, an alarming situation is emerging from Uttarakhand and Kerala
